Canceling a package holiday: What rights holidaymakers have

If you are unable to take a booked package holiday, you should first check the contract, time and reason for the cancellation. The decisive factor is whether it is a normal cancellation, special circumstances or a change by the organizer.

Key facts

  • Under German law, a package holiday usually combines at least two travel services, such as transport and accommodation, into one overall contract.
  • Before the start of the trip, travellers can withdraw from a package travel contract under Section 651h of the German Civil Code (BGB).
  • The organiser may be able to charge appropriate compensation; the contract terms and timing are important.
  • Unavoidable, exceptional circumstances at or near the destination can change the legal assessment.
  • Travellers should keep booking documents, notices, deadlines and evidence before sending a cancellation.

First check whether it is really a package holiday

Before every cancellation there is a simple but important question: Is it a package tour or individually booked services? A package tour combines several travel services into one package, for example flights and hotels. This is legally treated differently than a single flight, a separately booked holiday apartment or a single hotel booking. In the case of pure flight problems, the classification fits first Flight cancellation and delay.

Travelers should therefore check the booking confirmation, invoice and contract documents. It usually states who the organizer is, what services are included and what cancellation rules have been agreed.

What a standard cancellation means

The Civil Code regulates: § 651h BGBthat travelers can withdraw from the package travel contract before the start of the trip. At the same time, the organizer can demand appropriate compensation under certain conditions.

In practice, the cancellation conditions in the contract are often important. The compensation often increases the closer the start of the trip gets. Reisen-Tip deliberately does not give general percentage values because they can depend on the contract, the time and the specific case.

Assess exceptional circumstances carefully

A different situation may arise if unavoidable, extraordinary circumstances arise at the destination or in its immediate vicinity and significantly affect the execution of the trip. This point is also regulated in Section 651h BGB.

The exact situation is important: not every worry, news or general uncertainty is automatically enough. Travelers should check official notices, operator communications and the specific travel period before making any decisions. If rail or flight connections are affected by industrial action, the article on rail or airline strikes gives practical preparation steps.

What information travelers should secure

Anyone who has to cancel should keep the communication comprehensible. This includes booking number, contract documents, time of cancellation, reason for cancellation, medical or official evidence, notifications from the organizer and the response to the cancellation.

Cancellation should be made in writing if possible. Travelers should also pay attention to whether the organizer requires a specific form of contact and whether deadlines are specified in the contract.

Use EU information on package travel

The European Union explains basic rules for package travel and linked travel arrangements. This information helps travellers understand which rules may apply to their own booking.

This article is general travel information, not legal advice. If costs are high, cancellation fees are disputed or there are special circumstances, individual advice may be useful.

Think ahead before making a decision

A cancellation is rarely just a form question. Families and travellers with fixed dates should compare whether rebooking, leaving later or choosing another type of trip is more realistic. The guides on planning a vacation with children and travelling outside peak season can help with that decision.
